1. Acceptance of Terms

By downloading, installing, or using the K POP! mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legal agreement between you and K POP! ("we," "us," or "our") governing your use of the App.

2. Description of Service

K POP! is an educational mobile game that teaches Korean language and K-pop culture through interactive gameplay. The App includes:

  • Arcade-style demon-popping gameplay
  • Korean vocabulary lessons
  • K-pop group information and trivia
  • Progress tracking and achievements
  • Optional in-app purchase to remove advertisements

3. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on your personal mobile device
  • Use the App for personal, non-commercial purposes
  • Access the educational content provided within the App

This license does not allow you to:

  • Modify, reverse engineer, or create derivative works of the App
  • Use the App for commercial purposes
  • Distribute, sell, or lease the App to third parties
  • Remove or alter any proprietary notices or labels

4. User Conduct

You agree to use the App in accordance with all applicable laws and regulations. You will not:

  • Use the App in any way that could damage, disable, or impair the App
  • Attempt to gain unauthorized access to any portion of the App
  • Use any automated means to access the App or collect information
  • Use the App to violate any third party's rights
  • Circumvent or disable any content protection system

5. In-App Purchases

The App offers in-app purchases, specifically the option to remove advertisements for $4.99 USD.

  • All purchases are processed through Apple's App Store
  • Purchases are non-refundable except as required by law
  • Prices may vary by region and are subject to change
  • You are responsible for any taxes related to your purchase

To manage or cancel subscriptions, use your device's App Store settings. We do not directly handle payment information or refunds.

6. Intellectual Property

All content in the App, including but not limited to:

  • Game design, graphics, and animations
  • Korean language educational content
  • K-pop information and trivia
  • Sound effects and audio
  • Source code and software

is owned by us or our licensors and is protected by intellectual property laws. You may not use, copy, or distribute any content from the App without our prior written permission.

7. Third-Party Services

The App uses third-party services including:

  • Google AdMob: For advertisement display
  • Apple StoreKit: For in-app purchases

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS OF CONTENT

We do not warrant that:

  • The App will be uninterrupted or error-free
  • Defects will be corrected
  • The App is free of viruses or harmful components
  • The educational content will meet your specific learning needs

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • LOSS OF PROFITS, DATA, OR USE
  • DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APP

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless K POP!, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third party's rights
  • Any content you submit or share through the App

11. Educational Content Disclaimer

The Korean language content and K-pop information provided in the App is for educational and entertainment purposes only. While we strive for accuracy:

  • Language translations and pronunciations are simplified for learning
  • K-pop information may become outdated
  • Content should not replace formal language education
  • Cultural information is presented in a generalized manner

12. Updates and Modifications

We reserve the right to:

  • Update, modify, or discontinue the App at any time
  • Change these Terms with notice through the App or website
  • Modify features, content, or functionality
  • Change pricing for in-app purchases

Continued use of the App after changes constitutes acceptance of the modified Terms.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination:

  • Your license to use the App will cease immediately
  • You must delete all copies of the App from your devices
  • Provisions that by their nature should survive will remain in effect

14. Children's Use

The App is rated 4+ and suitable for all ages. Parents and guardians:

  • Are responsible for supervising children's use of the App
  • Should review these Terms with their children
  • Are liable for their children's compliance with these Terms
  • Can disable in-app purchases through device settings

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved exclusively in the courts of California.

16. Dispute Resolution

Any dispute arising from these Terms will be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.

You waive any right to a jury trial or to participate in a class action lawsuit.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and K POP! regarding the use of the App and supersede all prior agreements and understandings.

20. Apple-Specific Terms

If you are using the App on an iOS device:

  • These Terms are between you and us only, not with Apple
  • Apple has no obligation to provide maintenance or support for the App
  • Apple is not responsible for any product warranties
  • Apple is not responsible for addressing any claims relating to the App
  • Apple is a third-party beneficiary of these Terms with the right to enforce them
